Yakub To Be Hanged

Supreme Court has refused to stop the hanging of 1993 Mumbai blasts convict Yakub Memon.

His last minute petition for mercy was also rejected by Maharashtra Governor Vidyasagar Rao.

Legality Involved

It is pertinent to note that his review petition was dismissed by SC .Thereafter, a curative petition was filed in SC in year 2014 . It was also dismissed by SC.

Hence, the present petition was filed as a curative petition of the already dismissed curative petition under the guise that the composition of the bench was not proper .

Whereas, such curative petition has no locus standi .

President Mercy Petition Vs Death Warrant

Further, the application for mercy which is again filed with President of India by Yakub Menon cannot come to his help unless President himself stays the hanging .

Since, neither there is any legal provision nor the Jail authorities are required to wait till the time mercy petition is decided or to take permission from President before hanging Yakub Menon .

It is being claimed that previously his brother filed a mercy petition with the President . But , it was rejected . Therefore, this time Yakub himself has filed a mercy petition.

New Evidences

Oflate , some new evidences have surfaced due to the mail of Mr Raman which went public on 21st July 2015 by Rediff .  Mr Raman , the then RAW Head , was responsible for search operations of 1993 Bombay serial blasts . As per Mr Raman , Yakub has revealed various things which was useful for India to establish for the first time that Pakistan sponsored terrorism , details of terrorist camps et al

Conclusion

Even though , these facts were never before the Supreme Court till the time of  dismissal of first Curative Petition  in year 2014 , then too  it is an established fact  on record that Yakub Menon was conspirator of 1993 Bombay serial bomb blasts.
