  • Deployer: An entity “using an AI system under its authority,” except where the AI is used in a personal, non-professional capacity.

The compliance burdens for these two roles are vastly different. Attempting to shift this liability contractually to the upstream model developer is unlikely to be a viable strategy, as the AI Act places the primary obligation on the entity that puts the final product into the market under its own brand.
