NCLT Insolvency Lawyers India

Expert NCLT Insolvency Lawyers for Pan-India Representation
The Insolvency and Bankruptcy Code, 2016 (IBC) has fundamentally transformed the landscape of corporate insolvency and debt resolution in India. The National Company Law Tribunal (NCLT) is the primary quasi-judicial body that adjudicates all matters related to the insolvency, restructuring, and winding up of companies

Navigating the complexities of the NCLT requires specialized legal expertise and a strategic, time-sensitive approach.

AMLEGALS is a premier Indian law firm with a dedicated team of expert NCLT insolvency lawyers. With a presence in major economic hubs, we provide seamless representation before all NCLT benches across India, including Delhi, Mumbai, Kolkata, Chennai, Bengaluru, and Ahmedabad

  • Strategic advice on initiating insolvency proceedings.
  • Drafting and filing robust applications under Section 7 of the IBC.
  • Representation in NCLT hearings to ensure the admission of your application.

For Operational Creditors (Suppliers, Vendors, Service Providers) If you are struggling with unpaid corporate debts, we can help you leverage the IBC to recover your rightful dues. We provide expert guidance on:

  • Issuing the mandatory Demand Notice under Section 8 of the IBC.
  • Filing applications under Section 9 of the IBC to initiate CIRP against the defaulting company
  • Effectively countering claims of a “pre-existing dispute” to ensure your application is admitted.

NCLT Insolvency Process
The IBC is designed for time-bound resolution, typically within a 180 to 270-day timeframe

The key stages include:

  1. Filing of Petition: A financial or operational creditor files an application to initiate CIRP.
  2. Admission/Rejection: The NCLT hears both parties and decides whether to admit the case.
  3. Moratorium & IRP: Upon admission, a moratorium is declared, and an Interim Resolution Professional (IRP) is appointed to take control of the company.
  4. Resolution or Liquidation: The Committee of Creditors attempts to approve a resolution plan. If no viable plan is found, the company proceeds towards liquidation.
