However, the adoption of AI, especially General Generative AI (Gen AI), has raised serious privacy issues. Organizations and users are trying to comprehend the limits of these technologies, and how data can be safeguarded while computers do the data processing.

The deployment of AI models using extensive open-source data raises flag on issues such as unauthorized information utilization, retention, and leaking. These concerns are exacerbated with the increased reliance on AI as the mode of automating processes. Most business entities do not have enough control systems in place that will allow supervision for such AI dependant systems.

There is a great risk of losing the trust of the consumer, coupled with the legal risks that come with failing centralized governance. Such risks will be further augmented if there are no or weak Government regulations in place regarding the rapidly evolving AI technology and its uses.

PRIVACY RISKS IN GENERATIVE AI

The integration of Gen AI into a company’s operational framework raises intricate issues of privacy and intellectual property (IP) protection. The models are trained on a combination of publicly accessible and private data sources which raises the probability of data leaks and theft of information. Sensitive data can easily be lost, thus exposing businesses that use third-party AI solutions to security risks. These businesses have to reconsider the sharing of information.

An important development in the field is noted in OpenAI’s transition from being a non-profit organization to adopting a capped-profit model, which signals the ever-changing nature of AI governance.

Such changes in a company’s business strategy can also influence how data is organized, stored and even managed, amending the privacy terms between third party service vendors and clients. The gap whether the organization does remain in the control and supervision of AI service vendors is continually at risk. Such organizations ought to improve their data safety measures.

To avoid these threats, companies are seeking proprietary AI solutions more actively now. Organizations that need tailored AI systems can be more flexible with the data they have and ensure that accurate stringent security measures will be imposed. Unique protection is provided by hosting the AI systems in the privately owned cloud or the on-premise infrastructure. This minimizes the risk from outside sources.

CONSUMER TRUST AND PRIVACY CONCERNS

As AI-powered technologies rapidly integrate into everyday business operations, consumer concerns regarding data privacy have escalated. The widespread adoption of generative AI, virtual assistants, and machine learning models has sparked fears about how personal data is collected, processed, and potentially exploited. These concerns have led to shifting consumer trust dynamics, regulatory interventions, and a growing demand for responsible AI governance.

Erosion of Consumer Trust in AI-Driven Systems: A significant segment of society fears that AI technologies could be misused by corporations, government agencies, or rogue individuals, leading to data leaks, large-scale surveillance, or profiling without consent. The complexity of AI-powered systems has automated many processes, raising concerns about trust and the handling of sensitive data.

Although trust in AI technologies is low, certain factors can positively influence consumer trust, such as the purpose of data collection, the type of data being processed, and whether a company adheres to its stated policies.

For instance, there is a tendency for people to willingly share information so that they can receive customized recommendations that will suit the offered services, however, for financial eligibility profiling and workplace monitoring, they are less willing to be subjected to AI powered profiling.

Concerns Over Data Usage and Regulatory Compliance: One of the central issues affecting consumer trust is the uncertainty regarding how AI models handle personal data. Many AI-driven platforms rely on vast datasets sourced from public and private domains, raising concerns over data security and compliance with privacy laws. The IAPP Privacy and Consumer Trust Report underscores how consumers find it challenging to understand what data is being collected and how it is used, leading to a sense of helplessness in managing their privacy.

To address these concerns, regulatory bodies worldwide have stepped in with measures such as the European Unions’ (EU) AI Act, the Digital Personal Data Protection (DPDP) Act, 2023 in India, and Executive Order 14110 in the U.S. These frameworks aim to ensure greater accountability in AI data processing while enforcing stronger safeguards against privacy violations. However, regulatory compliance alone does not automatically translate into increased consumer trust, businesses must take proactive steps to demonstrate their commitment to ethical AI usage.

Balancing AI Innovation with Privacy Protection: While AI offers transformative benefits across industries, organizations must strike a balance between leveraging AI for efficiency and maintaining robust privacy protections. The risks associated with deploying generic AI models, as they may inadvertently expose proprietary or personal data to unintended parties. Similarly, companies relying on third-party AI vendors, such as OpenAI or cloud-based AI models, must remain cautious about evolving business models that could impact data ownership and security.

To foster greater consumer trust, businesses should consider:

  1. Transparency Initiatives: Providing clear, accessible disclosures on how AI models process user data.
  2. Privacy by Design: Embedding strong privacy controls into AI systems from the outset, rather than as an afterthought.
  3. User Control Mechanisms: Allowing consumers to opt out of AI-driven profiling or customize privacy settings.
  4. Regulated AI Deployments: Adhering to evolving global privacy regulations and maintaining compliance with jurisdiction-specific laws.

THE NEED FOR PROACTIVE DATA GOVERNANCE

To keep pace with developing AI regulations and consumers’ perceptions, companies need to take initiative towards data governance. Assigning responsibilities for data stewardship and adopting zero-trust security frameworks can tremendously improve privacy protection. In zero-trust systems, sensitive information is only made accessible with specific authentication checks in place to decrease the possibility of unauthorized breaches. Moreover, companies should focus on reducing the data footprint. Organizations can mitigate the risk of regulatory attention and information malpractice by minimizing the amount of personally identifiable information AI systems work with. Routine audits, as well as reports on transparency, can bolster the trust clients have in AI powered solutions.
