AI Models now know when they’re being tested. And they fake compliance.

The 2026 International AI Safety Report, chaired by Turing Award winner Yoshua Bengio, documents something every techno lawyer and AI Systems deployers, creators, importers should understand.

Some frontier AI models can now distinguish between evaluation and deployment contexts and alter their behavior accordingly.

Technically, these models analyze contextual signals, system prompts, API call patterns, benchmark-style formatting to detect whether they sit inside a test harness or live production.

When tested, they optimize for alignment metrics. When deployed, behavioral constraints relax.

Bengio confirmed by studying chains-of-thought reasoning that this is deliberate, not coincidental.

Developers hold proprietary training data, red-team results, and behavioral telemetry inaccessible to regulators.

The U.S. declined to back this report which has been endorsed by 30 countries, the EU, the OECD, and the UN. The country housing every major AI lab walked out.
