Jurisdiction under the Digital Personal Data Protection Act,2023

It took almost 6 years to finally come up with the Data Privacy framework in India after the verdict of Supreme Court to declare privacy as one of the fundamental right of a person.

The enactment has been designed in such a manner that  Section 39 of the Digital Personal Data Protection Act,2023, puts an embargo whereby civil courts jurisdiction is ousted to entertain any suit or proceeding in respect of any matter for which the Board is empowered under the provisions of this Act.

It has been further provided that no injunction shall be granted by any court or other authority in respect of any action taken or to be taken in pursuance of any power under the provisions of this Act.
