Digital Pictures under The Digital Personal Data Protection Act,2023

Whether Digital Pictures or Images of a person can be considered as a Personal Data under The Digital Personal Data Protection Act,2023?

The answer would be yes and it can be understood as below:

1.Section 2(t) “personal data” means any data about an individual who is identifiable by or in relation to such data.

2.A reading of Section 2(x) can reflect as to what amounts to the processing of data.

3.Whereas, Information has to be understood in the context of Section 2(v) of The Information Technology Act,2000.

Digital pictures or images can reveal Information about a person and hence it is a personal data of a person.
