Manpower Data and Challenged under Data Protection Law in India 

For a Data Protection Officer(DPO), the Manpower Data has been the biggest challenge and grey area worldwide.

The Digital Personal Data Protection Act, 2023 though exempts the personal data consented and given for specific purpose of the employment but still it will be an area of grave concern in India.

It is significant to note and understand that every Employer collect personal data from the job applicants and/or the employee, as the case may be, for a number of purposes:

a.to comply with law;

b.select for a person for an employment,

c.training

d.promotion;

e.to ensure personal safety and security,

f.quality control,

g.customer service and

h.other benefits where data of members of the family of the employee is also collected.

The moot challenge is the usage of such data in terms of the consent and in what manner it has been processed and records maintained to justify the same. The data flow and how it is maintained so that data protection is not breached is the main challenge for every organisation.
